1. Acceptance of Terms

By accessing or using myai.meme (“the Service”), operated by Hemant Manwani (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

myai.meme is an AI-powered meme generator that allows users to upload photos, generate AI captions, and create downloadable meme images. The Service is available as a free tier (with limited daily usage) and a paid Pro subscription.

3. User Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate information during registration. We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions and Payments

The Pro subscription is billed monthly at the price displayed at checkout. Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Prices are in USD and may be subject to applicable taxes. We accept major credit and debit cards including Visa, Mastercard, American Express, and other payment methods supported by Stripe.

All payment information is handled by Stripe, a PCI DSS Level 1 certified payment processor — the highest level of security certification in the payments industry. We never store your credit card number or sensitive financial data on our servers. All transactions are encrypted with industry-standard TLS/SSL technology.

5. Cancellation and Refund Policy

You may cancel your Pro subscription at any time from your account settings. Upon cancellation, you will retain access to Pro features until the end of your current billing period. No refunds are provided for partial billing periods. For full details, see our Cancellation & Refund Policy.

6. Acceptable Use

You agree not to:

• Upload illegal, obscene, defamatory, or infringing content
• Use the Service to harass, bully, or threaten individuals
• Attempt to reverse-engineer or exploit the Service
• Use automated bots or scrapers against the Service
• Circumvent rate limits or access restrictions

We reserve the right to remove content and suspend accounts that violate these guidelines.

7. Intellectual Property

You retain ownership of the photos you upload. The AI-generated captions and resulting meme images are provided for your personal and non-commercial use. The myai.meme brand, logo, and website design are our intellectual property.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee the accuracy, reliability, or appropriateness of AI-generated content. You use the Service at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or an in-app notice. Continued use of the Service after changes constitutes acceptance.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
